Terms of Use
These Terms of Use ("Terms") govern your use of okhlabs.com and the apps and services provided by OKH Labs LLC ("OKH Labs," "we," "us," or "our") (together, the "Services"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with the permission of a parent or guardian.
2. Accounts
Some Services may require an account. You are responsible for keeping your login information secure and for all activity under your account. Tell us promptly at support@okhlabs.com if you believe your account has been compromised.
3. License to use our apps
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use our apps on devices you own or control, for your personal, non-commercial use.
4. Purchases and subscriptions
In-app purchases and subscriptions are sold through Apple's App Store or Google Play and are governed by their terms, including billing, auto-renewal, cancellation, and refunds. You can manage or cancel subscriptions in your App Store or Google Play account settings. Refund requests are handled by Apple or Google under their policies.
5. Acceptable use
You agree not to:
- use the Services for any unlawful purpose;
- copy, modify, reverse engineer, or redistribute our apps except as permitted by law;
- interfere with or disrupt the Services or their security;
- attempt to access accounts or data that are not yours;
- use the Services to harass, abuse, or harm others.
6. Intellectual property
The Services, including all software, content, designs, logos, and trademarks, are owned by OKH Labs LLC or its licensors and are protected by law. These Terms do not give you any ownership rights in the Services.
7. Third-party services and content
The Services may include content, data, or links provided by third parties. We are not responsible for third-party content or services, and your use of them may be subject to their own terms.
8. Disclaimers
The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or secure.
9. Limitation of liability
To the fullest extent permitted by law, OKH Labs LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us for the Services in the 12 months before the claim or $50.
10. Indemnification
You agree to indemnify and hold harmless OKH Labs LLC from claims, damages, and expenses arising from your misuse of the Services or your violation of these Terms.
11. Termination
We may suspend or end your access to the Services at any time if you violate these Terms or if needed to protect the Services or other users. You may stop using the Services at any time.
12. Apple App Store terms
If you downloaded one of our apps from the Apple App Store, you acknowledge that these Terms are between you and OKH Labs LLC, not Apple, and that Apple is not responsible for the app or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the app must also comply with the App Store Terms of Service.
13. Governing law
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in New Jersey, unless applicable law requires otherwise.
14. Changes to these Terms
We may update these Terms from time to time. We will post the updated version on this page and change the effective date above. Continued use of the Services after changes means you accept the updated Terms.
